The military junta in Mali has officially designated Colonel Assimi Goita as the new president of the Republic of Mali.
The 37-year-old newly appointed president of Mali also doubles as the Head of the National Committee for the Salvation of the People (CNSP).
The Malian military junta based the appointment of the new president on the provisions in Article 32 of Title III of the 24 August 2020 Fundamental Act of the CNSP (N ° 001/CNPS of 24 August 2020) which stipulates that
“the national committee for the salvation of the people appoints from among its members a president who assumes the functions of Head of STATE”.
The Fundamental Act further stipulates that,
"when he is prevented from fulfilling his functions, temporarily or permanently, his powers are exercised by a Vice-President in the order determined by the Committee".
As such, the CNSP also maintains Colonel Malick Diaw as the vice-president of the Republic of Mali.
With respect to article 33 of the Fundamental Act of the CNSP, the president of the CNSP embodies national unity and is the guarantor of national independence, territorial integrity, respect for international treaties and agreements to which Mali is a party.
Diving deeper into Article 34 of the same Act, the president of the CNSP is vested with the powers to sign ordinances and decrees adopted by the CNSP.
As per Article 36 of the Act, the President of the CNSP has the powers to appoint ambassadors and extraordinary envoys to foreign powers, who are answerable to him.
Article 41 places the hammer on the nail by stipulating that the provisions of the Fundamental Act apply as constitutional provisions, supplement or supplement those of the Constitution of February 25, 1992.
This new government comes in barely hours after the “former” Malian President Ibrahim Boubacar Keita has regained his freedom from the putschists following international pressure.
Ibrahim Boubacar Keita was arrested by the mutinous army on 18 August 2020 and forced to announce his resignation on state media.
The military junta wants to rule Mali for a period of 3 years while they prepare to set up a transition governments.
IBK announced his resignation on state broadcaster in the late hours of Tuesday 18 August, same day he was arrested with his Prime Minister.
"For seven years I have with great joy and happiness tried to put this country back on its feet. If today some people from the armed forces have decided to end it by their intervention, do I have a choice? I should submit to it because I don't want any blood to be shed” IBK announced.
This coup d’état has been strongly condemned by the African Union Chairman Moussa Faki Mahamat, by the European Union, other regional and international bodies as well as some African and western countries.
The recent couple d’état in Mali has witnessed great condemnations from the international community.
Most recently, the European Union has temporarily suspended it’s training missions in Mali till further notice.
This pronouncement was made by the High Representative of the EU for Foreign Affairs and Security Policy, and vice-president of the EU Commission Josep Borrell Frontelles during the Informal meeting of EU Defence Ministers in Berlin on 26 August 2020.
The United Nations Security Council (UNSC) summoned an emergency meeting on Wednesday 19 August 2020 to discuss the political situation in Mali.
The African Union (AU), and the Economic Community of West African States (ECOWAS) have also sanctioned Mali by suspending its membership and called for the release of Ibrahim Boubacar Keita.
Today Friday 28 August 2020, ECOWAS member states will be meeting in a virtual extraordinary session to further discuss on the issue of Mali.
